Welcome to Shots on the House. This Privacy Policy describes how Shots on the House, Inc. ("Shots on the House," "we," "us," or "our") collects, uses, discloses, and protects information about you when you visit our website at shotsonthehouse.com (the "Site"), use our services, or otherwise interact with us.
Shots on the House is a nightlife discovery and bar rewards platform. We connect bar and venue enthusiasts with exclusive drink deals, happy hour alerts, and limited-time promotions from partner bars and venues in cities across the United States. We operate a permission-based email marketing program: every person on our mailing list has explicitly opted in to receive communications from us. We do not purchase, rent, or trade email lists.
Our principal place of business is in the State of Delaware. If you have any questions about this Privacy Policy or our data practices, please contact us at privacy@shotsonthehouse.com.
By using the Site or signing up for our services, you acknowledge that you have read, understood, and agree to the practices described in this Privacy Policy. If you do not agree, please do not use our Site or services.
We collect information in the following ways:
Information you provide directly to us. When you register for our service or fill out a form on the Site, you may provide us with:
Information collected automatically. When you visit our Site, our servers and third-party analytics tools may automatically collect certain technical information, including:
Cookies and similar tracking technologies. We use cookies and similar technologies as described in the Cookies section below (Section 10). You can manage cookie preferences through your browser settings.
We do not collect sensitive personal information such as government-issued identification numbers, financial account details, health information, racial or ethnic origin, or biometric data. We do not knowingly collect information from children under the age of 13.
We use the information we collect for the following purposes:
Service delivery. Your name, email address, and city are used to create and maintain your account, to identify you as a registered member, and to associate you with the correct city-specific deal alerts and promotions.
Transactional communications. We send transactional emails as a necessary part of providing our service. These include: welcome emails upon registration, redemption codes for specific promotions, confirmation emails for account-related actions (such as a password reset or an unsubscribe confirmation), and notifications about changes to our Terms of Service or Privacy Policy. Transactional emails are sent based on your relationship with us as a registered user and do not require separate marketing consent. You cannot opt out of transactional emails while you maintain an active account, as they are essential to service delivery.
Marketing communications. With your explicit prior consent — given by actively checking the opt-in checkbox on our signup form — we send marketing emails. These may include: weekly or periodic deal digest newsletters, city-specific happy hour and drink-deal alerts, announcements of new partner venues, seasonal promotions, and event-related offers from our venue partners. Every marketing email we send includes a clear, functioning, one-click unsubscribe mechanism. We honour opt-out requests promptly and in accordance with applicable law. You may withdraw your consent to marketing emails at any time without affecting the legality of processing based on consent given before withdrawal.
Analytics and improvement. We use aggregated and anonymised data about how visitors use the Site to understand which content is most useful, to fix technical issues, and to improve the overall quality of our service. Where we use third-party analytics providers (such as a web analytics service), we do so under contractual terms that limit their use of data and prohibit them from using your data for their own advertising purposes.
Legal compliance and safety. We may use your information to comply with applicable law, respond to lawful requests from government or regulatory authorities, enforce our Terms of Service, protect our rights and the rights of our users, and detect, prevent, or investigate fraud, security incidents, or other harmful activity.
We are committed to processing your personal data lawfully and transparently. Depending on which jurisdiction applies to you, the following legal bases may govern our processing activities:
Consent (GDPR Article 6(1)(a)). For individuals in the European Economic Area (EEA), United Kingdom, or other jurisdictions that require affirmative consent for email marketing, our legal basis for sending marketing emails is your freely given, specific, informed, and unambiguous consent, recorded when you actively check the opt-in checkbox on our signup form. You may withdraw this consent at any time by using the unsubscribe link in any marketing email or by contacting us at privacy@shotsonthehouse.com.
Contract performance (GDPR Article 6(1)(b)). Processing necessary to perform the contract we have with you as a registered user — such as sending transactional emails (welcome emails, redemption codes, account-related notices) — is carried out on the basis of contractual necessity.
Legitimate interests (GDPR Article 6(1)(f)). Certain processing activities, such as fraud prevention, network security, and internal analytics using aggregated data, may be carried out on the basis of our legitimate interests, where those interests are not overridden by your fundamental rights and freedoms.
CAN-SPAM Act compliance. For recipients in the United States, all marketing emails we send comply with the Controlling the Assault of Non-Solicited Pornography And Marketing Act of 2003 (CAN-SPAM Act). This means every marketing email: (a) accurately identifies the sender; (b) contains a truthful subject line; (c) discloses that the message is an advertisement or promotional communication where required; (d) includes our valid physical postal address; and (e) provides a clear and conspicuous mechanism for recipients to opt out of future marketing emails, which we honour within 10 business days.
California Consumer Privacy Act (CCPA / CPRA). California residents have specific rights regarding their personal information under the California Consumer Privacy Act (as amended by the California Privacy Rights Act). These rights are described in detail in Section 9 (Your Rights). We do not sell personal information, as that term is defined under California law, and we have not done so in the preceding 12 months.
We take the privacy of your information seriously. We do not sell, rent, trade, or otherwise transfer your personal information to outside parties for their own independent marketing or commercial purposes. Period. The following describes the limited circumstances in which your information may be disclosed to third parties:
Email service providers. We use third-party email delivery infrastructure providers (collectively, "email service providers" or "ESPs") to send, track, and manage our email communications. These providers process your email address and name on our behalf and are subject to strict data processing agreements that prohibit them from using your data for any purpose other than providing email delivery services to us. Our email service providers are bound by industry-standard security and compliance obligations, including CAN-SPAM and applicable anti-spam regulations.
Analytics providers. We may share anonymised or aggregated technical information (such as page view counts or click patterns) with web analytics providers to help us understand how our Site is used. Where any identifying information is processed by such providers, it is done so under contractual terms that restrict its use to providing analytics services to us.
Venue partners. When you redeem a deal at a partner venue, we may share with that venue the minimum information necessary to verify your redemption (for example, your name and a unique redemption code). We do not share your email address with venue partners for their independent marketing use without your separate, explicit consent.
Legal and safety disclosures. We may disclose your information if required to do so by law, regulation, or valid legal process (such as a subpoena, court order, or government demand). We may also disclose information where we believe in good faith that disclosure is necessary to protect the rights, property, or safety of Shots on the House, our users, or the public.
Business transfers. In the event that Shots on the House is involved in a merger, acquisition, restructuring, or sale of all or a portion of its assets, your personal information may be transferred as part of that transaction. We will notify you of any such change and provide you with the opportunity to opt out of the transfer by deleting your account prior to completion.
In all cases, any third parties that receive your personal information are required to protect it in a manner consistent with this Privacy Policy and applicable law.
Because email communication is central to our service, we want to be especially transparent about how we use it.
Transactional emails. Transactional emails are messages sent in direct response to actions you take as a registered user of our service. Examples include: the welcome email you receive when you create your account, the redemption code email you receive when you activate a deal, password reset emails, and notifications about material changes to our Terms of Service or Privacy Policy. These emails are sent as a necessary part of providing our service to you and are not marketing communications. You will receive them as long as you maintain a registered account with us, regardless of your marketing email preferences.
Marketing emails. Marketing emails are sent only to users who have explicitly opted in by actively checking the consent checkbox on our signup form. Marketing emails may include deal digests, happy hour alerts, new venue announcements, seasonal promotions, and other promotional content from Shots on the House or our partner venues. Every marketing email we send includes the following required elements:
Honouring opt-out requests. When you unsubscribe from our marketing emails — whether by clicking the unsubscribe link in an email, by contacting us at privacy@shotsonthehouse.com, or by any other method we make available — we will process your opt-out request and suppress your email address from future marketing sends within 10 business days of receiving your request, in compliance with the CAN-SPAM Act. In practice, we aim to process most opt-out requests within 2 business days. After opting out, you may continue to receive transactional emails related to your existing account until you delete your account entirely.
No purchased lists. We wish to state clearly and unambiguously: Shots on the House does not purchase, rent, harvest, scrape, or acquire by any other means email lists from third parties. Every individual on our mailing list has registered directly on our Site and has actively expressed their consent to receive marketing communications. This is a core operational policy and is non-negotiable.
We retain your personal information for as long as is necessary to provide you with our services and to fulfil the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law.
Specifically:
When personal information is no longer required, we will delete it securely or render it irreversibly anonymous in accordance with industry-standard data destruction practices.
We take the security of your personal information seriously. We implement a range of administrative, technical, and physical safeguards designed to protect your information against unauthorised access, disclosure, alteration, or destruction. These measures include encrypted connections (HTTPS/TLS) for all data transmitted between your browser and our servers, access controls limiting who within our organisation can access personal data, and contractual security requirements imposed on all third-party service providers who process data on our behalf.
Despite these measures, no method of transmission over the internet and no method of electronic storage is 100% secure. We cannot guarantee the absolute security of your information. In the event of a data breach that is likely to result in a high risk to your rights and freedoms, we will notify you and the relevant regulatory authorities as required by applicable law.
Depending on your jurisdiction, you may have the following rights with respect to your personal information. We will respond to verifiable requests in accordance with applicable law, generally within 30 days (or 45 days where an extension is lawfully permitted).
Right of access. You have the right to request a copy of the personal information we hold about you, including information about the categories of data collected, the purposes for which it is processed, and the third parties with whom it has been shared.
Right to correction. If any of the personal information we hold about you is inaccurate or incomplete, you have the right to request that we correct or update it. You can also update your name, email address, and city preferences by contacting us directly.
Right to deletion. You have the right to request that we delete the personal information we hold about you. We will honour deletion requests subject to any legal obligations that require us to retain certain information (for example, consent records required for regulatory compliance). Note that deleting your account will not remove your email address from our suppression list, which we maintain to prevent future accidental re-subscription.
Right to opt out of marketing. You may withdraw your consent to marketing emails at any time by: (a) clicking the "Unsubscribe" or "Manage Preferences" link at the bottom of any marketing email we send you; (b) emailing us at privacy@shotsonthehouse.com with the subject line "Unsubscribe"; or (c) using any opt-out mechanism we make available on the Site. Opt-out requests will be processed within 10 business days. Withdrawing marketing consent does not affect your receipt of transactional emails while your account remains active.
Right to data portability (GDPR). Where processing is based on your consent or the performance of a contract, and is carried out by automated means, you have the right to receive your personal data in a structured, commonly used, machine-readable format, and to transmit that data to another controller.
Right to object / restrict processing (GDPR). In certain circumstances, you have the right to object to our processing of your personal data or to request that we restrict such processing. Where processing is based on legitimate interests, we will cease processing unless we can demonstrate compelling legitimate grounds that override your interests.
California-specific rights (CCPA / CPRA). California residents have the right to: (a) know what personal information is collected, used, shared, or sold; (b) delete personal information we have collected from them (subject to certain exceptions); (c) opt out of the sale or sharing of personal information — note that we do not sell or share personal information as defined under California law; (d) non-discrimination for exercising their CCPA rights; and (e) correct inaccurate personal information. To exercise these rights, California residents may submit a request to privacy@shotsonthehouse.com or by contacting us by post at our address below.
To exercise any of the above rights, please contact us at privacy@shotsonthehouse.com. We may ask you to verify your identity before processing your request in order to prevent unauthorised access to your information.

Types of cookies we use:
Managing cookies. Most web browsers allow you to control cookies through their settings. You can set your browser to refuse all cookies, accept only first-party cookies, or notify you before accepting a cookie. Strictly necessary cookies cannot be disabled without impairing the core function of the Site.
Do Not Track. Some browsers offer a "Do Not Track" (DNT) feature that signals your preference not to be tracked across websites. If you are a parent or guardian and believe that your child under the age of 13 has provided us with personal information without your consent, please contact us immediately at privacy@shotsonthehouse.com. If we become aware that we have inadvertently collected personal information from a child under 13, we will take prompt steps to delete that information from our systems.
Persons between the ages of 13 and 20 are also not eligible to register for our service due to the alcohol-related nature of our content. By registering, users represent and warrant that they are at least 21 years of age.
Our Site may contain links to third-party websites, including the websites of our partner venues. These third-party sites have their own privacy policies and are not governed by this Privacy Policy. We are not responsible for the privacy practices or content of any third-party website. We encourage you to review the privacy policy of any site you visit before providing personal information.

Where we transfer personal data from the European Economic Area (EEA) or the United Kingdom to the United States or other third countries, we take steps to ensure that appropriate safeguards are in place, such as entering into standard contractual clauses approved by the European Commission or other lawful transfer mechanisms.
We may update this Privacy Policy from time to time to reflect changes in our practices, the services we offer, or applicable law. When we make material changes to this Policy, we will update the "Last updated" date at the top of this page and, where appropriate, notify you by email or by placing a prominent notice on our Site prior to the change becoming effective. Material changes include, but are not limited to, changes in how we use your personal information, changes to the categories of information we collect, and changes to the third parties with whom we share information.
We encourage you to review this Privacy Policy periodically to stay informed about our data practices. Your continued use of the Site after the effective date of any changes constitutes your acceptance of the revised Policy. If you do not agree with any changes, you should stop using our Site and may request deletion of your account and personal information as described in Section 9.
