These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Shots on the House, Inc. ("Shots on the House," "we," "us," or "our"), a corporation incorporated under the laws of the State of Delaware. These Terms govern your access to and use of the Shots on the House website located at shotsonthehouse.com (the "Site") and all services, features, content, and functionality offered through or in connection with the Site (collectively, the "Service").
By accessing or using the Site or the Service in any way — including by browsing the Site, completing our registration form, receiving emails from us, or redeeming any offer or promotion — you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety, as well as our Privacy Policy, which is incorporated into these Terms by reference.
If you do not agree to these Terms, you must immediately cease all use of the Site and the Service and, if you have registered an account, request deletion of your account by contacting us at hello@shotsonthehouse.com.
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date above and, where feasible, notify registered users by email. Your continued use of the Site or Service after the effective date of any modification constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
Shots on the House is a nightlife discovery and bar rewards platform that connects registered members with exclusive drink deals, happy hour alerts, and limited-time promotional offers from partner bars, restaurants, and entertainment venues (collectively, "Venue Partners") in select cities across the United States.
The Service operates as a permission-based email notification platform. Upon registering an account and providing explicit consent to receive marketing communications, members receive periodic emails containing promotional offers from Venue Partners in their designated city. Members may redeem eligible offers by presenting a unique redemption code — provided by email or otherwise made available through the Service — at participating Venue Partners.
The Service includes two categories of communications:
Shots on the House acts as an intermediary platform and is not responsible for the quality, safety, legality, or availability of any offer, product, or service provided by a Venue Partner. Offers are subject to the Venue Partner's own terms, availability, and any applicable law governing the sale and service of alcohol.
We reserve the right to modify, suspend, or discontinue the Service or any part of it at any time, with or without notice, and without liability to you. We may also add new features, impose limits on certain features, or restrict access to parts of the Service.
The Service involves the promotion and facilitation of access to alcoholic beverages. Accordingly, the Service is strictly limited to individuals who meet all of the following eligibility criteria:
We reserve the right to verify your eligibility at any time and to terminate any account we have reason to believe is registered to a person who does not meet the eligibility requirements above. Providing false information about your age or identity is a material breach of these Terms and may be subject to legal consequences.
To access the full benefits of the Service, including receiving deal alerts and redeeming offers, you must register for an account. By registering, you agree to the following:
Accurate information. You agree to provide accurate, current, and complete information during the registration process, including your first name, a valid email address, and your city or metropolitan area. You agree to update this information promptly if it changes. Providing false, misleading, or incomplete information is a breach of these Terms and may result in suspension or termination of your account.
Account security. You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@shotsonthehouse.com if you become aware of any unauthorised access to or use of your account. We are not liable for any loss or damage arising from your failure to maintain account security.
One account per person. Each individual may maintain only one registered account with the Service. Creating multiple accounts, or registering on behalf of someone else without their knowledge and consent, is prohibited.
Email consent. During registration, you will be presented with a checkbox — unchecked by default — asking for your explicit consent to receive marketing emails from Shots on the House. Checking this box constitutes your affirmative opt-in to receive marketing communications as described in these Terms and our Privacy Policy. You may withdraw this consent at any time by using the unsubscribe mechanism in any marketing email or by contacting us. Withdrawing marketing consent does not close your account or affect your receipt of transactional emails.
Account termination by you. You may close your account at any time by contacting us at hello@shotsonthehouse.com. Upon account closure, we will cease sending marketing communications and will process the deletion of your personal data in accordance with our Privacy Policy and applicable data retention obligations.
Account termination by us. We reserve the right to suspend or permanently terminate your account, with or without notice, if we determine, in our sole discretion, that you have violated these Terms, provided false registration information, engaged in fraudulent or abusive use of the Service, or for any other reason we deem necessary to protect the integrity of the Service or the safety of our users and Venue Partners.
You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. The following activities are expressly prohibited:
Any violation of this Acceptable Use policy may result in immediate suspension or termination of your account, and we reserve the right to refer matters involving potential criminal activity to appropriate law enforcement authorities.
Promotional offers made available through the Service are provided by our Venue Partners and are subject to the following conditions:
All offers are subject to availability and may be modified, suspended, or withdrawn by the Venue Partner or by Shots on the House at any time without prior notice. Shots on the House does not guarantee the continued availability of any specific offer.
Redemption codes are intended for personal, single-use redemption only unless otherwise expressly stated. Codes may not be sold, transferred, reproduced, or used by any person other than the registered member to whom they were issued.
Each Venue Partner may impose additional terms, conditions, and restrictions on the redemption of offers, including but not limited to: minimum purchase requirements, time-of-day restrictions, excluded menu items, limits per table or per visit, and blackout dates. Shots on the House is not responsible for any Venue Partner's terms or for a Venue Partner's refusal to honour a redemption code.
Offers facilitated through the Service may involve the service of alcoholic beverages. You acknowledge that you are legally responsible for consuming alcohol responsibly, in accordance with the laws of your jurisdiction, and that Shots on the House bears no responsibility or liability for any consequences arising from your consumption of alcohol at a Venue Partner's establishment.
Shots on the House does not warrant or represent that the offers available through the Service represent the best available pricing or that similar deals are not available elsewhere. The Service is provided as a convenience to both members and Venue Partners.
All content, materials, and features available on or through the Site and the Service — including but not limited to text, graphics, logos, button icons, images, audio clips, data compilations, software, and the design, selection, and arrangement of such materials — are the proprietary property of Shots on the House, Inc. or its licensors and are protected by United States and international copyright, trademark, trade dress, patent, and other intellectual property laws.
The "Shots on the House" name and logo, and any other product or service names, slogans, or logos used on the Site, are trademarks of Shots on the House, Inc. and may not be used in connection with any product or service that is not ours without our prior written consent, or in any manner that is likely to cause confusion or that disparages or discredits Shots on the House.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Site and the Service for your personal, non-commercial use. This licence does not include the right to: collect or harvest any personally identifiable information from the Site; use the Site for any commercial purpose or for any public display (commercial or non-commercial); modify or create derivative works based on the Site's content; use any data mining, robots, scrapers, or similar data gathering or extraction tools; or download (other than page caching) any portion of the Site.
Any reproduction, redistribution, or other use of the Site's content beyond the scope of the limited licence granted above is expressly prohibited and may result in civil or criminal penalties.
Shots on the House operates its email marketing programme in strict compliance with applicable law, including the CAN-SPAM Act of 2003 and, to the extent applicable, the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA/CPRA).

THE SITE AND THE SERVICE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SHOTS ON THE HOUSE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
SHOTS ON THE HOUSE DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (B) ANY DEFECTS IN THE SERVICE WILL BE CORRECTED; (C) THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) ANY OFFER OR PROMOTION MADE AVAILABLE THROUGH THE SERVICE WILL BE AVAILABLE, HONOURED, OR OF ANY PARTICULAR VALUE.
The information provided on the Site, including information about Venue Partners and their offers, is provided for general informational purposes only. We do not represent or warrant the accuracy, completeness, reliability, or timeliness of such information. You rely on information provided through the Service at your own risk.
Shots on the House does not endorse, recommend, or make any representation regarding the quality, safety, or suitability of any Venue Partner or any alcoholic or non-alcoholic product or service offered by a Venue Partner. Venue Partner relationships are disclosed where applicable, and the existence of a partnership does not constitute an endorsement beyond facilitating the relevant promotional offer.
Nothing in these Terms shall be construed to limit or exclude disclaimers or limitations that cannot be excluded under applicable mandatory consumer protection law in your jurisdiction.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SHOTS ON THE HOUSE, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SERVICE PROVIDERS, OR SUCCESSORS AND ASSIGNS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF, OR INABILITY TO USE, THE SERVICE — INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS, LOSS OF DATA, LOSS OF GOODWILL, PERSONAL INJURY, OR PROPERTY DAMAGE — EVEN IF SHOTS ON THE HOUSE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL CUMULATIVE LIABILITY OF SHOTS ON THE HOUSE TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT, IF ANY, PAID BY YOU TO SHOTS ON THE HOUSE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED US DOLLARS ($100.00).
Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you in full. In such jurisdictions, Shots on the House's liability shall be limited to the greatest extent permitted by law.
You acknowledge that the limitations of liability in this Section are a fundamental element of the basis of the bargain between you and Shots on the House, and that Shots on the House would not provide the Service without these limitations.
You agree to defend, indemnify, and hold harmless Shots on the House, Inc. and its officers, directors, employees, agents, licensors, Venue Partners, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the Service in any manner not authorised by these Terms; (c) your violation of any third party's rights, including any intellectual property rights or privacy rights; (d) any claim that content you submit to or through the Service caused damage to a third party; or (e) your violation of any applicable law or regulation.
The Site may contain links to third-party websites, including the websites of Venue Partners and other businesses. These links are provided for your convenience only. Shots on the House has no control over the content, privacy policies, or practices of any third-party website, and we disclaim all responsibility for them. The inclusion of any link on our Site does not imply endorsement, approval, or affiliation with the linked website. You access any third-party website at your own risk and subject to that website's own terms and conditions.
Governing law. These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation — including non-contractual disputes or claims — shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law principles.
Jurisdiction. You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Service shall be brought exclusively in the state or federal courts located in the State of Delaware, and you hereby irrevocably consent to the personal jurisdiction and venue of such courts and waive any objection based on improper venue or inconvenient forum.
Informal dispute resolution. Before filing any formal legal claim, you agree to attempt to resolve any dispute informally by contacting Shots on the House at hello@shotsonthehouse.com and providing a written description of the dispute, your name, your contact information, and the relief you are seeking. We will attempt to resolve the dispute within 30 days of receiving your notice. If the dispute is not resolved within that period, either party may pursue formal legal remedies.
Class action waiver. To the extent permitted by applicable law, you agree that any dispute resolution proceeding will be conducted only on an individual basis, and not in a class, consolidated, or representative action. You waive any right to bring or participate in a class action, class arbitration, or any other representative proceeding.
Limitation period. Any cause of action or claim you may have arising out of or relating to these Terms or the Service must be commenced within one (1) year after the cause of action accrues, otherwise such cause of action or claim is permanently barred.
If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, it shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.
No waiver by Shots on the House of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure by Shots on the House to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
These Terms, together with our Privacy Policy and any other legal notices, policies, or guidelines published by us on the Site, constitute the entire agreement between you and Shots on the House with respect to the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Service. No representations, warranties, or other inducements made by either party not contained herein shall be of any force or effect.
